Hermès Requests Court Assistance to Halt Metabirkin NFT Sales Following Trademark Trial Win

In February, Hermès won a trial against Mason Rothschild’s MetaBirkin NFTs and is now seeking court assistance to put a stop to NFT sales. According to Reuters, the luxury design house has filed a request with a Manhattan federal court to prevent Rothschild from promoting or owning his MetaBirkin NFTs after a jury found they violated Hermès' trademark rights. Hermès is taking action despite winning the trial, which awarded them $133,000 USD in damages, as Rothschild has continued to market his NFTs. This case is significant as it is the first of its kind in the U.S, with Hermès suing Rothschild in January 2022 for infringing upon their intellectual property and trademark rights by creating fake Hermès products in the metaverse.
